1. Acceptance of Terms
By accessing or using hooksfastpitch.com (the "Site"), registering for any Hooks Fastpitch program, or submitting information through any form on the Site, you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or submit information to us.
These Terms constitute a legally binding agreement between you and Hooks Fastpitch. We reserve the right to modify these Terms at any time; continued use of the Site after modifications are posted constitutes acceptance of the updated Terms. See Section 12 for more on changes.
2. Description of Services
Hooks Fastpitch provides the following through hooksfastpitch.com:
- Informational content about our youth fastpitch softball programs, coaching staff, and organization
- Team roster pages, schedules, and game result summaries
- Tryout information and scheduling
- A player registration platform for families to enroll in our programs
- Sponsor recognition and alumni information
- Contact and communication tools for families and prospective participants
All features are provided to support the operations of Hooks Fastpitch as a competitive youth softball organization. The Site is not a general-purpose sports platform; it is operated solely for Hooks Fastpitch programs and activities.
3. User Accounts
Accounts on hooksfastpitch.com are created and managed by parents and legal guardians of registered or prospective players. By creating an account, you represent that:
- You are at least 18 years of age
- You are the parent or legal guardian of any minor player registered under your account
- All information you provide is accurate, current, and complete
- You will maintain and update your account information to keep it accurate
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Hooks Fastpitch immediately if you become aware of any unauthorized use of your account. Hooks Fastpitch is not liable for any loss or damage resulting from unauthorized access to your account.
4. Registration and Fees
Registration fees for each season are established and published by Hooks Fastpitch prior to the registration window opening. The following conditions apply:
- Submission of a registration form and payment of the applicable fee is required to confirm a roster spot for a player.
- Roster spots are not guaranteed until full payment is received and confirmed.
- Tournament entry fees, if applicable, are separate from seasonal registration fees and are billed on a per-tournament basis.
- Fees are subject to change between seasons. The current fee schedule will always be displayed on the Site at the time of registration.
Please review our Refund Policy for information about cancellations and refunds. Submission of payment constitutes your agreement to the Refund Policy.
5. Code of Conduct
Hooks Fastpitch is committed to providing a safe, respectful, and positive environment for all athletes, families, coaches, staff, officials, and volunteers. By participating in Hooks Fastpitch activities or using the Site, all users agree to:
- Treat all athletes, coaches, staff, officials, and other families with respect and dignity
- Refrain from abusive, threatening, discriminatory, or harassing language or behavior — whether online or at events
- Respect all decisions made by coaches regarding rosters, playing time, and team matters
- Support a positive athletic experience for all players, including those on opposing teams
- Follow all venue rules and the rules of the applicable softball governing bodies (USSSA, NSA, etc.)
Hooks Fastpitch reserves the right, in its sole discretion, to suspend or permanently remove players, families, or other users from the program or the Site for violations of this Code of Conduct, without refund where permitted under our Refund Policy.
6. Prohibited Uses
You agree not to use hooksfastpitch.com for any of the following purposes:
- Scraping, crawling, or systematically downloading content from the Site without prior written authorization
- Sending unsolicited communications ("spam") to other users, coaches, or staff
- Attempting to gain unauthorized access to any portion of the Site, its servers, or related systems
- Uploading or transmitting viruses, malware, or any other malicious code
- Using the Site for any commercial purpose — including advertising, solicitation, or resale of data — without the prior written consent of Hooks Fastpitch
- Impersonating any person or entity, or misrepresenting your affiliation with any person or entity
- Collecting or harvesting personal information of other users from the Site
- Any use that violates applicable local, state, federal, or international law or regulation
7. Intellectual Property
The intellectual property associated with hooksfastpitch.com is divided between two parties, as follows:
7.1 Platform Infrastructure
The website code, software architecture, design systems, templates, custom components, and all technical infrastructure underlying hooksfastpitch.com are the proprietary intellectual property of BellexFire Agency. All rights reserved. This intellectual property may not be reproduced, copied, modified, distributed, or used in any manner without the prior written consent of BellexFire Agency.
7.2 Organizational Content
All league data, team rosters, game schedules, game results, player statistics, coaching staff information, organizational text, team photographs, and other materials reflecting the activities and identity of Hooks Fastpitch are the intellectual property of Hooks Fastpitch. All rights reserved. This content may not be reproduced or redistributed without the prior written consent of Hooks Fastpitch.
7.3 Trademarks
The name "Hooks Fastpitch," the Hooks Fastpitch logo, and any associated marks are trademarks of Hooks Fastpitch. The name "BellexFire Agency" and associated marks are trademarks of BellexFire Agency. Nothing in these Terms grants you any right to use the trademarks of either party.
8. Disclaimer of Warranties
hooksfastpitch.com and all content, features, and services available through the Site are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. Hooks Fastpitch and BellexFire Agency expressly disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding the accuracy, completeness, or timeliness of content on the Site
- Warranties of uninterrupted or error-free access to the Site
Your use of the Site is at your sole risk. Hooks Fastpitch does not warrant that the Site will meet your requirements or that any information on the Site is free of errors.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Hooks Fastpitch and BellexFire Agency, and their respective officers, directors, employees, volunteers, agents, and contractors, shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, goodwill, or other intangible losses
- Damages resulting from unauthorized access to or alteration of your data or transmissions
- Damages resulting from the conduct of any third party on or through the Site
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), and even if Hooks Fastpitch or BellexFire Agency has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, this limitation may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Hooks Fastpitch, BellexFire Agency, and their respective officers, employees, volunteers, agents, and contractors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your use of hooksfastpitch.com
- Your violation of any provision of these Terms
- Your violation of any third-party right, including any intellectual property right or privacy right
- Any claim that content you submitted caused damage to a third party
11. Governing Law and Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Site shall be resolved in the state or federal courts located in McLennan County, Texas, and you consent to the personal jurisdiction of such courts.
12. Changes to These Terms
We may modify these Terms of Service at any time by posting updated Terms on hooksfastpitch.com. We will update the "Last Updated" date at the top of this page when changes are made. For material changes, we may also provide notice through the Site or by email to registered users. Your continued use of the Site after updated Terms are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Site.
13. IP Ownership Summary
For clarity, the intellectual property ownership arrangement governing hooksfastpitch.com is summarized as follows:
