Liability Waiver
1. Parties
This Liability Waiver, Assumption of Risk, and Indemnification Agreement ("Waiver") is entered into by the undersigned parent or legal guardian ("Participant") on behalf of themselves and their minor child, and Hooks Fastpitch, a youth sports organization located at 1847 Jackson Lane, China Spring, Texas 76633 ("Organization").
By signing below, Participant affirms that they are the parent or legal guardian of the minor player named in this document and have the legal authority to execute this agreement on the minor's behalf.
2. Acknowledgment of Risk
Participant acknowledges and understands that participation in fastpitch softball and related activities — including but not limited to practices, tryouts, games, clinics, and travel — involves inherent risks. These risks include, but are not limited to:
- Physical injury from contact with batted balls, thrown balls, or pitched balls
- Physical injury from falls, slides, and collisions with other players, coaches, fencing, or equipment
- Sprains, strains, fractures, contusions, and other orthopedic injuries
- Head, neck, and spinal injuries
- Injuries resulting from overexertion, fatigue, or dehydration
- Illness or injury related to exposure to heat, cold, or severe weather conditions
- Injuries sustained during travel to and from Hooks Fastpitch activities
- Any other risk inherent to competitive youth athletics
Participant acknowledges that this list is illustrative and not exhaustive, and that no list can fully describe all possible risks associated with participation in athletic activities.
3. Voluntary Participation
Participant confirms that their minor child's participation in Hooks Fastpitch activities is entirely voluntary. Participant acknowledges that they have been informed of and understand the risks described in Section 2, and that they freely and voluntarily choose to allow their minor child to participate despite those risks.
4. Release of Liability
To the fullest extent permitted by applicable Texas law, Participant hereby releases, waives, and forever discharges Hooks Fastpitch and its coaches, directors, officers, volunteers, agents, employees, sponsors, and representatives (collectively, "Released Parties") from any and all claims, demands, damages, causes of action, liabilities, costs, and expenses of any kind — whether known or unknown, foreseen or unforeseen — arising out of or related to:
- The minor player's participation in any Hooks Fastpitch activity, program, practice, game, tournament, or event
- Any injury to the minor player's person, including bodily injury, permanent disability, or death
- Any damage to or loss of the minor player's personal property
- Any injury or damage caused by the ordinary negligence of any Released Party
PARTICIPANT UNDERSTANDS THAT THIS RELEASE INCLUDES CLAIMS BASED ON THE NEGLIGENCE OF THE RELEASED PARTIES AND IS INTENDED TO BE AS BROAD AND INCLUSIVE AS PERMITTED UNDER TEXAS LAW.
5. Medical Authorization
In the event of an injury, illness, or medical emergency affecting Participant's minor child during or in connection with any Hooks Fastpitch activity, and in circumstances where Participant cannot be reached in a timely manner, Participant hereby authorizes Hooks Fastpitch staff, coaches, and volunteers to:
- Call emergency medical services (911) on behalf of the minor player
- Consent to emergency medical treatment, including transport by ambulance to the nearest appropriate medical facility
- Provide medical personnel with the minor player's known medical information to the extent it has been provided to Hooks Fastpitch
This authorization does not obligate Hooks Fastpitch to provide or arrange medical care; it is granted solely to allow staff to act in an emergency when the parent or guardian is unavailable. All costs of emergency medical care are the sole responsibility of Participant.
6. Indemnification
Participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, suits, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:
- The minor player's participation in Hooks Fastpitch activities
- Any act or omission of the minor player during Hooks Fastpitch activities
- Any breach of this Waiver by Participant
7. Governing Law
This Waiver shall be governed by and construed in accordance with the laws of the State of Texas. Any dispute arising out of or relating to this Waiver shall be resolved in the state or federal courts of McLennan County, Texas.
8. Severability
If any provision of this Waiver is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of this Waiver shall continue in full force and effect.
9. Entire Agreement
This Waiver constitutes the entire agreement between the parties with respect to the assumption of risk, release of liability, medical authorization, and indemnification for Hooks Fastpitch activities. It supersedes all prior oral or written understandings on those subjects. No amendment to this Waiver shall be valid unless made in writing and signed by both parties.
Participant acknowledges that they have had the opportunity to read this Waiver in its entirety, have had the opportunity to ask questions about its contents, and sign it freely and voluntarily.
